Forkiee Terms of Service

These terms apply when you use the Forkiee app for iPhone and this website. They are written for diners, not lawyers. The part that matters most is the one about allergies: Forkiee helps you read a menu, but only the kitchen knows what is in your food.

Who we are

Forkiee is made by Third Floor Studios, based in Leeuwarden, the Netherlands, and registered with the Dutch Chamber of Commerce (KvK) under number 42027191. In these terms, “we” and “us” mean Third Floor Studios. You can reach us at support@forkiee.app or in the app under Settings, Write to us.

The agreement

By using Forkiee you agree to these terms. You get the app through Apple’s App Store, so Apple’s Licensed Application End User License Agreement applies too. Where the two differ about your licence to use the app, Apple’s agreement wins. How we handle your information is described in our privacy policy.

You should be at least 16 to use Forkiee, or use it with the permission of a parent or guardian.

What Forkiee does

You photograph a menu, printed, handwritten or on a screen, in any language. Forkiee reads it with an AI model, explains the dishes in your language, checks each one against the Taste Passport you filled in (allergies, intolerances, diets and goals) and suggests what to order. You can ask follow-up questions, show an allergy card to the staff, split the bill from a photo and keep your dinners in your Taste Passport. Calories, protein, carbohydrates and fat are shown as estimates, and you can choose to add them to Apple Health. If you like, Friends lets the people you choose see the tables you keep.

Forkiee can be wrong, and the kitchen decides

Please read this part carefully, especially if you have a serious allergy.

  • Forkiee reads the menu, not the kitchen. Its answers come from what is written on the menu and from how dishes are usually made. Recipes change, kitchens substitute ingredients, and traces can come from shared fryers, pans and surfaces. A dish marked “For you” is a suggestion, not a guarantee that it is free of anything.
  • An AI model can misread. Handwriting, glare, an unfamiliar language or an unusual dish can lead to a wrong translation, a missed ingredient or a wrong verdict. Forkiee says when it is unsure, but it cannot always know.
  • Always tell the staff about an allergy and confirm with them before you order. The allergy card and the sentences Forkiee suggests are there to help you ask, not to replace asking.
  • Numbers are estimates. Calories and macros are estimated from the dish name and usual recipes. They are not measured and can be far off.
  • Not medical advice. Forkiee does not diagnose, treat or prevent any condition. Talk to a doctor or dietitian about your diet, allergies and health. Patterns from your check-ins are hints to discuss with them, not diagnoses.
  • In an emergency, call the local emergency number. The emergency card in the app can help you explain, but it does not call anyone.

You decide what you eat. We do our best to make Forkiee careful and accurate, but we cannot accept responsibility for what a restaurant serves or for a reaction to it.

Forkiee Pro

Forkiee is a subscription app. Forkiee Pro is sold through Apple’s App Store as a monthly or a yearly subscription. The yearly plan starts with a 7-day free trial when your Apple Account is eligible for one. The price is shown in the app before you buy and can differ by country.

  • Apple charges your Apple Account when you confirm the purchase, or when the free trial ends.
  • The subscription renews automatically unless you turn off auto-renewal at least 24 hours before the end of the current period. You can manage or cancel it in your Apple Account settings, or in Forkiee under Settings, Manage subscription.
  • If you cancel during the free trial, you are not charged. Payments, refunds and the cancellation rights that apply where you live are handled by Apple under its own terms.
  • Deleting the app or erasing its data does not cancel a subscription.
  • If we change the price, the new price applies from your next period, and Apple tells you first when the law or its rules require it.

Fair daily limit. Every menu Forkiee reads costs us real money, so there is a fair limit on how many new menus one phone can read in a day. It is set so that dining out as usual never comes close. If you reach it, Forkiee tells you, and it resets the next day. Follow-up questions about a menu you already scanned do not count towards it.

Your photos and information

The menus, bills and plates you photograph, the questions you ask and your Taste Passport stay yours. You allow us to process them only to give you Forkiee’s answers, as described in the privacy policy. When you add people to your table, please do so only if they are happy for you to use their name and food rules this way.

Friends

Friends is optional. If you join it, these extra terms apply:

  • Your account. You sign in with Apple and choose an @name. Use one account for yourself, do not pretend to be someone else, and do not pick a name that misleads or offends people.
  • What you share stays yours. You keep the rights to your photos, captions and comments. You allow us to store them and show them to the people you chose (your approved followers, or anyone signed in to Friends if your profile is open), only to run Friends, until you hide or delete them.
  • Share with care. Share only photos and words you have the right to share, and think of the people in your photos before you post them.
  • Be decent. No insults, harassment, hate, sexual content, threats or spam, and no personal details such as phone numbers, addresses or links. Comments are checked automatically before they are posted, and some will be refused.
  • Blocking, reports and suspension. You can block anyone, and report tables, comments and people. We review reports and may remove anything that breaks these terms, and suspend an account that breaks them, without warning when that is needed to protect others. If you think we got it wrong, write to support@forkiee.app.
  • Other people’s tables are their own experience. What someone else ate safely is no guarantee for you: the kitchen still decides, and the section on allergies above applies.
  • Leaving. You can delete your Friends account at any time in Settings, Delete my Friends account. What that removes is described in the privacy policy.

Fair use

When you use Forkiee, please do not:

  • use it for anything unlawful, or to harm or harass anyone,
  • send photos or text that you have no right to use,
  • try to get around the daily limit, the subscription or our security,
  • copy, scrape or resell Forkiee’s answers or service at scale, or use it to build a competing service,
  • reverse engineer or decompile the app, except where the law allows it,
  • overload or disrupt the servers Forkiee runs on.

If someone seriously or repeatedly breaks these terms, we may stop their phone from reaching our server. When we can, we tell them first by email if they have written to us.

What belongs to us

The Forkiee app, its design, its name and logo, its dish photo library, and the text and images on this website belong to Third Floor Studios or to the people who licensed them to us. You may use them only to use Forkiee for yourself. The answers Forkiee writes for you are yours to keep and share.

Changes and availability

We keep improving Forkiee, so features can change, and some depend on services run by others, such as the AI model provider, Apple Maps or the App Store. We cannot promise that Forkiee will always be available or free of errors. If we stop offering Forkiee, we will say so in the app and on this website in advance, and end automatic renewals.

Our liability

Nothing in these terms limits your rights as a consumer under the law, or our liability where the law does not allow it to be limited, for example for damage we cause on purpose or through gross negligence. Apart from that, and as far as the law allows, we are not liable for indirect or consequential loss, and our total liability to you is limited to what you paid for Forkiee in the 12 months before the claim.

Stopping

You can stop using Forkiee at any time. Settings, Erase everything on this phone removes what Forkiee keeps on your iPhone, and deleting the app removes it too. Remember to cancel your subscription separately in your Apple Account settings.

Changes to these terms

When we change these terms, we update this page and the date at the top. For changes that matter, we tell you in the app or in the App Store release notes before they apply. If you keep using Forkiee after that, the new terms apply; if you do not agree, you can stop and cancel your subscription.

Law and disputes

Dutch law applies to these terms. If you are a consumer living in another country, you also keep the protection of the mandatory laws of that country, and you can bring a dispute to the courts where you live. Before that, please write to us: most things are solved faster that way.
